If they lied on a form, they have poisoned their own well.

Several years ago a child in a day camp had a seizure in a swimming pool. Fortunately the child was okay, and the parents were very upset at the camp counselors and the pool staff. They threatened to sue, but then it was revealed that the child had had seizures before and but that was not included on the health form needed to attend the camp.Chrishttps://www.blogger.com/profile/14428361191787397415noreply@blogger.comtag:blogger.com,1999:blog-3609683919099708226.post-66617774707642707082012-01-27T11:41:55.973-05:002012-01-27T11:41:55.973-05:00@Chris

If there is any demonstrable harm from the parents' actions, there might be a case to be made. From my understanding thus far, the only untoward thing that's happened is that the staff with unknown immune status required extra physician visits and Ig administration. Hopefully she and the other woman were far enough along in their pregnancies that the risk of CVS was low in the event they actually did get infected.

As for the day care, I don't know all the details. If they were negligent in checking/verifying records according to the applicable regulations, they might stand to lose their license. That would mean they would be shut down, at least for a time.

There are a number of legal issues at play here, depending on the party you're looking at, and I don't begin to claim I know enough about either the case as a whole nor about the applicable laws to venture any guess as to what could happen.Todd W.https://www.blogger.com/profile/16192694127268195554noreply@blogger.comtag:blogger.com,1999:blog-3609683919099708226.post-7005778731316824562012-01-27T11:35:47.885-05:002012-01-27T11:35:47.885-05:00Could there be some kind of legal action taken aga...Could there be some kind of legal action taken against the parents who faked the immunization record? Also, I am not sure how the day care could have verified the vaccination status of the children unless the parents gave them permission to contact their health care provider.Chrishttps://www.blogger.com/profile/14428361191787397415noreply@blogger.com
